Madof was not prosecuted to provide a distraction, that would have required the SEC to notice the fraud before Madof “confessed” to his son’s (and probable accomplices) and they turned him in. The SEC didn’t investigate, it got given the case on a platter. It’s happening now because investors got nervous and wanted to put their money into something else in case the stock market crashed. There was no money.
